2. Scout reports
- Scout reports are informational research compiled from public records, listings and other available sources at the time of preparation.
- While we work hard to be accurate, information such as zoning, HOA rules, land fees and availability can change without notice. You are responsible for independently verifying all material facts before making any purchase decision.
- Package scope (number of properties, inclusions and turnaround) is as described at the time of order or as otherwise agreed in writing.
- No guarantee of accuracy; reports provided “as is.” Reports and Essentials shortlists are compiled by people from third-party and publicly available sources and are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory. All site content, reports, branding and creative produced by Post & Rail USA remain the property of Penn Kingsley Media unless otherwise agreed. Reports are for the client's personal use and may not be resold or redistributed.
6. Limitation of liability
To the maximum extent permitted by law, Penn Kingsley Media is not liable for any loss arising from reliance on scout report contents or from the performance of promotional placements. Our total liability is limited to the amount paid for the relevant service. In any event, and to the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to our services, a report or a shortlist is limited to the amount you actually paid us for the specific report or service giving rise to the claim.
